REVIEW DRAFT — NOT YET EFFECTIVE

Version: [TERMS VERSION]
Effective date: [EFFECTIVE DATE]

1. Who we are and when these Terms apply

Reapone is provided by Reapone (PTY) Ltd., a South African private company, registration number [REGISTRATION NUMBER], with its business address at 1a Loerie Street, Randpark Ridge, Randburg, 2156, South Africa (“Reapone”, “we”, “us”). Contact us at [LEGAL CONTACT EMAIL]. Our business telephone number is +27 68 144 0715. Our website is https://reapone.pages.dev.

These Terms govern your use of the Reapone fitness and nutrition application and its connected account services (the “Service”). They become an agreement when you affirmatively accept the approved version presented to you. If you do not agree, do not create an account or continue through an acceptance step. Reading a product preview or this draft does not create an account or enroll you in a paid service.

Our separate Privacy Notice at https://reapone.pages.dev/privacy/ explains personal-information processing. Agreement to these Terms is not, by itself, consent to optional marketing or every use of sensitive information.

2. Eligibility and your account

You must be at least 18 years old, have legal capacity to enter this agreement under the law that applies to you, and give accurate account and onboarding information. Reapone is intended for individuals tracking their own fitness and nutrition.

You may be offered email/password registration or sign-in through Apple or Google. Available methods depend on the configuration of the Service and the relevant provider. Email verification, additional identity checks or reverification may be required for access or sensitive actions. Keep your sign-in credentials secure and maintain access to the email address or provider you use. Do not impersonate another person or access their account without authorization. Tell us at [SUPPORT EMAIL] if you believe your account has been compromised.

Your targets and summaries depend on the details and records you provide. Check them and correct errors. Avoid putting another person's personal information into your private notes or records unless you are authorized to do so.

3. What Reapone provides

The current Service lets you:

  • complete a fitness profile and receive estimated calorie and macronutrient targets and an illustrative weight-goal timeline;
  • log food quantities, calories and macronutrients, grouped as Breakfast, Lunch, Dinner and Snacks; create personal foods and save favorites;
  • look up products through an online food database and, on supported devices with permission, scan a retail barcode or enter its numbers manually;
  • browse exercise-session templates and instructions, record completed sets, repetitions and loads, track a session's duration, and enter cardio distance and notes;
  • record weigh-ins and view summaries and charts from your saved records; and
  • edit supported records and settings, sign out, or request account deletion through the app.

Features depend on device support, connectivity and service availability. An optional camera is used for barcode scanning; declining permission does not prevent manual barcode entry.

Reapone does not currently provide a clinician or human coach, medical monitoring, meal-photo identification, wearable measurements, a public social feed or a generative-AI assistant. Information about possible future features is not a commitment to provide them.

4. Nutrition, exercise and automated estimates

Reapone provides general fitness and nutrition information, not medical advice, diagnosis or treatment. Its estimates and workout information do not replace advice from a qualified healthcare professional, registered dietitian or appropriately qualified exercise professional.

Nutrition targets use formulas and information you enter, including age, height, weight, gender selection, activity and goal pace. They do not assess your full health circumstances, medications, pregnancy, injury, eating-disorder history or other individual needs. A formula, input range or available goal does not establish that a particular intake, weight or pace is safe or appropriate for you.

Projected dates and animated progress curves are illustrations based on the selected starting point, target and rate. They are not a prediction or guarantee of weight change, muscle gain, fitness improvement or achievement by a date. General workout templates and their duration/level labels do not establish your readiness or safe technique. Consult a qualified professional before relying on a plan where your circumstances require individualized guidance. Stop an activity if you feel unwell or experience concerning symptoms; do not use the app to obtain urgent care.

Food entries may be generic estimates, your own entries or community-supplied product information. Products, recipes, portions and labels can differ or change; some nutrients may be missing. Check the packaging, serving amount and values before saving. Reapone is not an allergen, ingredient, religious-diet or food-safety verification service.

Consumption summaries reflect what you record, not independently measured intake. Some nutrition averages exclude days with no logged meals. A progress chart or target should be interpreted alongside its dates, units and underlying entries.

5. Your records and permission to operate the Service

You retain any ownership and intellectual-property rights you have in the information and content you enter, including personal food entries, meal logs and workout notes (“Your Content”). Providing content to Reapone does not transfer those rights to us. Third-party product data, images and other material remain subject to their own rights and licenses.

You give us a non-exclusive permission to store, reproduce, process and display Your Content only as needed to provide the account services you use, including calculating your summaries, saving and retrieving records, securing the Service and carrying out deletion. We may use our service providers for those purposes. This permission is not a license to publicly advertise with your private records or to train a generative-AI model on them.

The permission ends when the relevant content is permanently deleted, except for any limited continued processing that is lawfully required and described in the approved Privacy Notice. You must have the rights or authorization needed to provide Your Content. This section does not replace privacy-law requirements or give us an unrestricted right to use personal information.

6. Appropriate use and technical limits

Use the Service lawfully and respect other people's privacy and rights. Do not:

  • use stolen credentials, impersonate someone or attempt to read or change records you are not authorized to access;
  • introduce malicious code, disrupt the app or its providers, or exploit the Service to harm others; or
  • bypass authentication, account-owner controls, barcode/search restrictions or other protective technical limits, including by abusive automated requests.

These are rules for using the actual account and lookup services, not a statement that every violation is automatically detected. They do not prohibit activity protected by applicable law or rights expressly granted by a relevant open-source or third-party license.

Online food lookup has technical and provider rate limits and may temporarily reject requests. Data-entry fields also have supported sizes and ranges. Such limits do not represent medical safety thresholds, a promise of a fixed number of searches, unlimited storage or uninterrupted access. The app provides an error or a supported alternative where implemented; for example, food nutrition can be entered manually.

7. Charges

The current release is free to use. Premium subscriptions are planned but are not currently offered through the reviewed Service. This version has no paid subscription, automatic renewal, paid trial or in-app purchase. Your internet or mobile provider may charge for connectivity under your separate agreement with it.

These Terms do not authorize any future charge, recurring payment, cancellation fee or trial conversion. A paid offering requires its own disclosed price, payment and cancellation/refund terms and any agreement required by applicable law. No non-refundable-payment or waiver-of-refund term is created here.

8. Third-party services and materials

Reapone uses Clerk for account authentication and Supabase for account-data services. Optional Apple and Google sign-in depends on the availability and rules of the provider account you choose. Your separate agreement with a sign-in provider continues to govern that provider's service. Reapone's obligations to you under these Terms and applicable law are not displaced by using a supplier.

Food search and barcode lookup use Open Food Facts, a community database. A search term or barcode is sent to that provider for lookup. Some native requests may connect directly from your device when a server lookup is temporarily unavailable; camera photos are not submitted by the barcode feature. Details of personal-information handling belong in the approved Privacy Notice.

Open Food Facts database material is supplied under the Open Database License; individual contents are subject to the Database Contents License, and product images are supplied under the applicable Creative Commons Attribution–ShareAlike license. See Open Food Facts data and attribution information. Those licenses govern relevant reuse of their material; they do not make your private food or health diary public. Brand marks and other third-party rights may apply separately.

Vendor integrations or source links do not establish endorsement, verified nutrition or guaranteed coverage. No requirement to open an Open Food Facts account or accept every infrastructure vendor's business contract is imposed by these Terms.

9. Reapone materials and software licenses

We and our licensors retain the rights we respectively hold in the Service's branding, interface, software and supplied content. You may use the provided app and materials to use the Service in accordance with these Terms. Your rights in Your Content remain as described in section 5.

Open-source components and separately licensed material retain their applicable notices and permissions. Nothing in these Terms withdraws a right granted by an applicable open-source or third-party license, or restricts an act that applicable law permits. These Terms do not claim that Reapone exclusively owns all underlying components, product images or food-database information.

10. Records, signing out and account deletion

Signing out or uninstalling the app does not delete your account or server records. Removing a meal, workout or personal food hides it from the active log; the current implementation marks that record as removed rather than immediately erasing its database row. The app normally loads the most recent 90 days of meal/workout history. This display window is not an automatic erasure deadline.

To close your account, open Settings → Delete Account, complete any identity verification, type DELETE and confirm permanent deletion. Availability depends on account-deletion and cleanup services being ready. Account closure is intended to be irreversible. Ensure you have independently retained any information you need before confirming; these Terms do not promise an in-app export or recovery tool.

Identity deletion triggers asynchronous cleanup of the associated Reapone profile, meals, personal foods/favorites, workouts and weigh-ins. Cleanup may finish after the identity closes and may require retry if delivery fails. We do not promise an instantaneous purge from every supplier or backup. A one-way account-subject security marker is retained to prevent a still-valid deleted-account token from writing new records. [CONFIRM AND DESCRIBE BACKUP/LOG RETENTION, SECURITY-MARKER RETENTION AND REQUEST HANDLING IN THE PRIVACY NOTICE.]

Questions or deletion failures can be raised at [SUPPORT EMAIL]. Nothing here limits statutory access, correction, erasure or complaint rights.

11. Access restrictions and ending the relationship

You may stop using Reapone at any time and may close your account as described above. The Service rejects unauthorized, expired or deleted-account access; temporary limits can also affect online lookup.

[OPERATOR POLICY TO CONFIRM: specify any additional grounds for suspension/termination, proportionate notice, urgent security/legal exceptions, any opportunity to correct a breach or request review, and the review contact. No termination-for-convenience right or guaranteed appeal workflow is assumed by this draft.]

Ending the relationship does not remove rights or liabilities that already arose, applicable third-party license requirements, or obligations that must continue under applicable law. It does not authorize indefinite retention of Your Content.

12. Availability, warranties and liability

Important: no provision of these Terms excludes a right or remedy that applicable law does not allow to be excluded, including applicable consumer and personal-information rights.

The Service depends on networks, your device and external providers and may be unavailable or interrupted. We do not make a separate promise of continuous availability, error-free food data, clinical suitability or a particular health or fitness result. These factual limitations do not relieve us of a legally required standard of care or service quality.

[COUNSEL/OWNER TO CONFIRM ANY PERMITTED WARRANTY DISCLAIMERS, CATEGORIES OF EXCLUDABLE LOSS AND A FAIR LIABILITY CAP, INCLUDING ITS CURRENCY AND BASIS. THIS DRAFT SETS NO MONETARY CAP AND NO BLANKET EXCLUSION OF OUR LIABILITY.] Any approved allocation must preserve liability that cannot lawfully be limited, including applicable consequences of fraud, deliberate misconduct, gross negligence or injury, and any non-waivable consumer/data-protection remedies.

No indemnity or class-action waiver is imposed by this draft. The proposed arbitration arrangement in section 14 requires the bracketed details and jurisdictional review before it can be adopted.

13. Changes to the Service and these Terms

Features may be updated as the product develops. An update must not be used to take away rights that applicable law protects. A proposed fee or materially different service is not automatically accepted merely because the app is updated.

[CONFIRM A WORKABLE METHOD AND REASONABLE LEAD TIME FOR MATERIAL-CHANGE NOTICES, EFFECTIVE DATES AND ANY REQUIRED FRESH ACCEPTANCE.] An amended Terms version must be made available to you. Changes do not apply retroactively to an existing dispute unless the law permits and you validly agree. If you do not agree to a change, you may stop using the Service and close your account, without losing rights you already have.

14. Governing law, disputes and contact

These Terms are governed by [GOVERNING LAW]. Subject to mandatory consumer rights and any legally required access to local courts or regulators, disputes may be brought before [COURTS AND VENUE — CONFIRM WHETHER NON-EXCLUSIVE]. The operator intends to use arbitration for disputes that may lawfully be arbitrated. [ARBITRATION PROVISION TO COMPLETE AND APPROVE: specify the covered disputes, legal seat, independent arbitration institution and rules, appointment/number of arbitrators, language, remote-hearing availability, fair allocation of filing/arbitrator fees, and any notice or opt-out process required in each launch market.] No fee allocation, mandatory individual-only procedure, class-action restriction or waiver of access to regulators is inferred from this placeholder.

Any final arbitration agreement must preserve mandatory consumer rights, any right to reject arbitration where applicable, available small-claims remedies and appropriate urgent court relief. The court venue above is for matters lawfully remaining with a court, including permitted assistance with or review/enforcement of arbitration. [CONFIRM THE PRECISE CONSUMER EXCEPTIONS AND COURT JURISDICTION.]

Please contact [LEGAL CONTACT EMAIL] about these Terms or [SUPPORT EMAIL] about your account. Contacting us does not suspend a legal deadline or require you to delay exercising a statutory remedy.
